Below is a summary of the Terms & Conditions you agree to when you sign up for any of the YAMA Foundation classes, workshops, programs or events -
以下是閣下報名參與任何YAMA基金會的課程、工作坊,計劃或活動時所需同意的條款細則摘要:
I hereby agree to the following terms and conditions for YAMA Foundation, stated below :
本人謹此同意YAMA基金會下例所述之各項條款和條件:
I understand that it is my responsibility to consult with a medical professional prior to and regarding my (or my child’s) participation is the class / workshop / program. I understand that it is my responsibility to determine whether I (or my child) can practice any yoga postures and participate at my own risk.
本人清楚明白是本人的責任在自己(或孩子)參加任何課程/工作坊/計劃之前,應該先諮詢醫學專家;本人亦有責任在自己(或孩子)是否適合練習任何/某些瑜伽姿勢作出正確判斷和決定,並自行承擔風險。
Where relevant, I agree to share crucial information such as medical reports, letters, evaluations by teachers, doctors and/or therapists with the instructor(s) to help determine the appropriate approach for me (or my child.)
在相關的情況下,本人明白及同意與導師分享任何重要資料:例如與醫療有關之報告及信件;老師、醫生和/或治療師的評估,以幫助確定適合本人(或孩子)的方案。
As a student, I agree to go at my own pace and avoid straining my body. I understand that all students are free to skip any posture or end any posture early.
作為學生的身分,本人明白及同意按照自己身體能承擔的步伐和自我調節 來活動,避免因身體緊張而弄成傷害。本人亦知道所有學生都可以自行選擇隨時可略過或提前結束任何姿勢。
I will not hold the instructor(s) responsible for any injury during or arising from my (or my child’s) participation in this class/workshop/program. I agree to exercise reasonable and sensible caution for my (or my child’s) wellbeing while practicing yoga under any circumstances, whether inside or at an exterior location.
本人將不追究導師對我(或孩子),於參加本基金會舉行的任何課程/工作坊/項目期間或因其引起的任何傷害的責任。本人同意在任何情况下練習瑜伽時,無論是在室內還是在室外,都要對我(或孩子)健康狀況採取明智合理的謹慎態度。
I understand that I am responsible for my own personal property.
本人明白必須對保管自己的個人財物負全責。
I agree to pay the appropriate fees on time regarding my (or my child’s) participation.
本人同意按時支付參與YAMA基金會所舉辦的課程/工作坊/項目所需的費用。
Photo Release PERMISSIONS 照片發佈許可權
Below are the permissions you grant to us to use photographs/video/recordings of all activities related to the YAMA Foundation:
以下是閣下授權本會使用與 YAMA基金會相關的所有活動的照片/錄像/錄音的權限:
I grant to YAMA Foundation, its representatives and employees the right to take photographs of me (or my child) and my property in connection with the above-identified subject.
本人授權 YAMA Foundation、其代表和員工就上述提及的項目拍攝本人(或孩子)及本人財物的權利。
I authorise the YAMA Foundation, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that the YAMA Foundation may use such photographs of me (or my child) with or without my (or my child’s) name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.
本人授權 YAMA基金會及其版權的轉讓人和受讓人,以印刷和/或電子方式使用和出版版權。本人亦同意 YAMA基金會可以使用帶有/或沒有本人或孩子的名字的照片,並用於任何合法目的,包括例如宣傳,插圖,廣告和互聯網內容等。
ARRANGEMENTS DURING TYPHOON OR BLACK RAIN STORM
颱風或黑色暴雨期間的安排
When a Typhoon No. 8 , Typhoon No. 3, Black Rain Storm or Red Rain Storm weather warning is hoisted during non-working hours (ie., overnight or early morning), all in-person sessions will be cancelled for the rest of the day.
當八號颱風、三號颱風,黑色或紅色豪雨天氣警報在非工作時間(即隔夜或清晨)懸掛時,餘下時間內所有面對面之活動將取消。If a session is cancelled due to bad weather, the trainer/teacher of the session will reach out to students to determine the feasibility of continuing the class online or postponing the lesson to a later date. The decision of whether to go online or postpone will rest with the majority.
如果由於惡劣天氣而取消的課堂,該課堂的導師將聯系學生相討,以決定該課堂是否以網上上課或改期。而群體課程該決定將以大多數人取決。In the event that a T8 or Black Rain Storm warning is hoisted during a training day / session, the session will be cancelled immediately allowing time for students to return home safely. The session will be postponed to a later date.
如果在培訓日/上課期間懸掛T8(八號颱風)或黑色豪雨警告,課堂將立即取消,以便學生們有充足時間安全回家。該課堂亦將會被押後。Studios will not reopen for half-day sessions.

COVID-19 SAFETY MEASURES & PROCEDURES

The safety of our clients are top priority. We will follow Hong Kong’s Centre for Health Protection’s guidelines in maintaining social distancing to prevent the spread of the Novel Coronavirus.
客戶的安全位于本會關注的首位。我們會遵循香港衛生防護中心的指導方針,保持社交距離,以防新型冠狀病毒的傳播。If restrictions prevent trainings/workshops to happen in-person, the sessions will move automatically online via Live cast of the class so students can participate via a computer or telephone screen. The trainers and teachers will provide you with the log-in details accordingly.
如果因疫情限制而無法上面授培訓/課堂,課堂將自動改為網上直播,學員可以透過電腦或手提電話視象參與。屆時培訓師和導教師將為您提供相應的登入詳情。As social distancing measures ease, we will slowly integrate back to in—person sessions on a part online/part in-person basis, ensuring that all participants have an equal opportunity to practice in-person.
隨著社交距離措施的放寬,我們將續漸以部分網上/面授方案,慢慢重新融入完全面授。讓各參與者都有平等的機會親自練習。Participants will be required to sign a mandatory health declaration prior to any attendance in person, have their temperature checked, wear a face mask and frequently wash hands.
參與者必須在出席時簽署強制性健康聲明,檢查體溫,戴口罩和勤洗手。If any teacher/staff/participant shows any sign of illness, we will instruct them to stay home and self-isolate.
如果任何導師/員工/參與者出現任何疾病迹象,我們將指示他們留在家中並自我隔離。If you have travelled outside of Hong Kong very recently, please refrain from attending any in-person sessions at the studio for at least 21 days.
如果您最近曾到過香港以外地區,請至少21天不要參與本會任何的面授課堂。If you have been in contact with/suspect to have been in contact with someone with Covid-19, please postpone attending any sessions in person for two weeks or until cleared by your medical team. As a precaution, we encourage you to stay home and self-isolate until you are cleared.

Waiver of Liability 責任豁免
In further consideration of me (or my child) being permitted to participate in the class / workshop / program, I knowingly, voluntarily and expressly waive any claim I may have against Hersha Chellaram, YAMA Foundation, their instructors, assisting staff, sponsors of event, affiliate organisations or sponsoring location for any injury or damages or death that may be sustained as a result of my (or my child’s) participation in this program.
I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue for any injury or death caused by their negligence or other acts.
在進一步考慮本人(或本人的孩子)被允許參加課程/工作坊/計劃,本人清晰知道,自願地及明確放棄任何對 Hersha Chellaram女士, YAMA基金會, 其導師們、輔助人員、活動贊助商、附屬組織或贊助地點,因本人(或本人的孩子)參與活動時受的任何傷害/損害或死亡之索賠。
本人、本人的繼承人或法定代理人將永遠免除、放棄、解除和立約不會因其疏忽或其他行為造成的任何傷亡而提起訴訟。
Personal Information Collection Statement & PERSONAL DATA PRIVACY 個人資料及私隱收集聲明
Please note that YAMA Foundation collects your personal information through your submission of Registration Forms, participation in classes, workshops and community events, and of course signing up to our mailing lists at events, or through electronic or verbal requests for further information.
敬請注意,YAMA 基金會會透過以下方式收集您的個人資料:您提交的報名表格、課堂、工作坊和社群活動的參與、本會通訊訂閱,透過電郵或口頭的資訊請求。
For us to process your registration and provide information and services, we will require you to provide your personal information to us. This applies to both existing and potential students. YAMA Foundation will use your personal information for registration, for provision of services and for marketing & promotional and membership purposes.

Please note that failure to provide sufficient personal information as requested in the mandatory fields on this Registration Form will render us unable to provide your requested services.

Personal information held by YAMA Foundation will be kept confidential but we may provide such data to our contractors or third-party service providers who process applications & orders and provide mailing services, marketing support & research activities on our behalf. To enable their execution of the above services, we will need to provide them with access to personal information on a minimum need-to-know basis. However, we will impose the strictest requirements of security and confidentiality on their data handling. They will not be permitted to use the personal information for anything else other than providing the required services set out above. Unless we have informed you beforehand and have obtained your authorization, or are obliged to do so by law and regulatory authorities, we will not under any circumstances disclose your personal information.

According to Personal Data (Privacy) Ordinance, you have the right:
- to check whether we hold personal data about you and
- to access such data;
- to require us to correct inaccurate data; to ascertain our policies and practices in relation to personal data and the kind of personal data held by us.
